1. These terms

This website is operated by Migroo Pty Ltd (trading as VisaQA), ABN 17 686 506 918 ("VisaQA", "we", "us"). By using this website you agree to these terms. If you do not agree to them, please do not use the website.

These terms govern this website only. They do not govern the VisaQA platform, which is not publicly available and which will be provided under separate terms.

2. What this website is

This website describes VisaQA, a pre-lodgement quality assurance platform being developed for Australian migration practices, and provides a way to ask us about it.

It is an information and enquiry website. It is not the VisaQA platform, it does not provide access to the platform, and using it does not create any entitlement to access the platform.

3. No advice

Nothing on this website is legal advice, migration advice, or advice of any other kind, and nothing on it should be relied on as advice.

We do not provide immigration assistance as that term is used in the Migration Act 1958 (Cth). Nothing on this website is a substitute for the professional judgement of a registered migration agent or an Australian legal practitioner, or for advice about your own circumstances.

Articles published in the Insights section are general commentary on practice management, technology and operational risk, written for professionals. They are not advice, they are current only as at their stated date, and they may not reflect subsequent changes in law, policy or departmental practice.

4. Accuracy and availability

We take reasonable care with the content of this website, but we do not warrant that it is accurate, complete or current. Content may change without notice.

We do not warrant that the website will be available uninterrupted or free of errors, and we may suspend, withdraw or change any part of it at any time.

5. Statements about the future

This website may contain statements about VisaQA's development and expected availability, including indicative timing.

Those statements reflect our current intentions and expectations. They are not commitments, they are subject to change, and development timing may move. You should not make a business decision in reliance on any indicated date. Where we describe features or capabilities of the platform in general terms, those descriptions relate to a product under development and may change before it is made available.

6. Enquiries and information you send us

Do not send us information about your clients or their matters through this website. The "Please do not send us client or matter information" section of our Privacy Policy explains this and what we do if it happens.

Anything you do send us through this website is sent on a non-confidential basis, except for your own personal information, which we handle in accordance with our Privacy Policy. We do not accept unsolicited confidential or privileged material through this website, and sending it does not create a duty of confidence.

Contacting us through this website does not create a lawyer and client relationship, a retainer, or any professional engagement.

7. Preview access

Requests for access to the private VisaQA preview are reviewed before access is issued. We may grant or decline a request at our discretion, and we may withdraw access. Access is currently offered to Australian migration practices and selected industry participants.

Material provided inside the preview is provided in confidence and on the terms notified with it.

8. Intellectual property

All content on this website, including text, graphics, logos and layout, is owned by us or used under licence, and is protected by copyright and other intellectual property laws.

You may read this website and print or save individual pages for your own professional reference. You may not otherwise reproduce, republish, adapt or distribute any part of it without our written permission.

"VisaQA" and the VisaQA mark are our trade marks.

9. Automated access

You may not use automated means to scrape, harvest or systematically download content from this website, or attempt to gain unauthorised access to any part of it or the systems it runs on.

10. Third parties

This website uses a third-party form service to receive enquiries, and may link to third-party websites such as professional profiles. We are not responsible for the content, practices or availability of third-party websites, and a link is not an endorsement.

11. Liability

Our liability to you is limited as far as the law allows.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, we limit it to resupplying the relevant service or paying the cost of having it resupplied.

Subject to the above, and to the extent permitted by law, we are not liable for any loss or damage arising from your use of this website or from reliance on anything on it, including indirect or consequential loss, loss of profit, or loss of opportunity.

Our Privacy Policy explains how we handle personal information collected through this website and forms part of these terms.

13. Governing law

These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that place and of the courts able to hear appeals from them.

We may change these terms. The current version is always the one on this page, and the "last updated" date shows when it changed. Continuing to use the website after a change means you accept the amended terms.
